BY USING THE NATPE.COM WEBSITE AND RELATED WEBPAGES (THE “WEBSITE”) OR ANY OF THE CONTENT MADE AVAILABLE VIA THE WEBSITE AND ANY OTHER OF OUR ONLINE SERVICES OR WEBSITES (INDIVIDUALLY AND COLLECTIVELY THE “NATPE SERVICES”) YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY.

We adjusted our Privacy Policy to reflect the new General Data Protection Regulation that came into effect on May 25, 2018. We may update this policy from time to time by publishing a new version on our website. You should check this page occasionally to ensure you are happy with any changes to this policy. When the changes are significant we will attempt to notify you by email or through the private notification features of our websites and services.

This privacy notice does not cover the links within this site linking to other websites. We encourage you to read the privacy statements on the other websites you visit.

You acknowledge and agree that it is your responsibility to maintain a valid email address as a registered user to receive any notice of change to this Policy periodically and to be aware of any modifications. Your continued use of our website after such modifications will constitute: (a) your acknowledgment of the modified Policy; and your consent to the modified Policy Notice.

1.         How we use your information

This privacy notice tells you what to expect when the NATIONAL ASSOCIATION OF TELEVISION PROGRAM EXECUTIVES, INC. (“NATPE” or “we” or “us” or “our”) collects your personal information. It applies to information we collect to connect members of the content industry throughout the Professional Television/Entertainment Industry:

•           visitors to our websites and affiliated NATPE web pages hosted elsewhere on the internet.
•           surveys on our websites and affiliated NATPE web pages hosted elsewhere on the internet.
•           complainants and other individuals in relation to a data protection or data subject’s complaint or enquiry under the General data Protection regulation (GDPR);
•           people who use our services, e.g. create a user account, register for a membership, program, conference and/or exhibition, order a product or service, submit content and/or post content in discussion forums or other public areas, enter a contest or sweepstakes, fill out a survey, or send us feedback);
•           job applicants and our current and former employees.

Our websites and services are not designed for or marketed to minors. We do not knowingly collect or solicit personal information from minors, and we do not knowingly allow minors to use our websites or services. If you are a minor, please do not use our websites or services or send us any information about yourself. If we learn that we have collected personal information from a minor, we will delete that information as quickly as possible. If you believe that a minor may have provided us personal information, please contact us at privacy@natpe.org. 

Because an essential function of our website is performing customized matches and business searches largely based upon the information you consent to our use of any information you provide to us for this purpose. Please read the information below to learn what types of information we are collecting and what may happen to that information you input to and through our website and affiliated NATPE web pages hosted elsewhere on the internet. 

When someone visits www.natpe.com we use a third party service, Google Analytics, to collect standard internet log information and details of visitor behavior patterns. We do this to find out things such as the number of visitors to the various parts of our website. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website. When we collect personally identifiable information through our website, we are up front about this. We make it clear when we collect personal information and explain what we intend to do with it.

A. Personally Identifiable Information

This refers to information that lets us know the specifics of who you are. When you engage in certain activities on this site, such as creating a user account, registering for a membership, program, conference and/or exhibition, ordering a product or service, submitting content and/or posting content in discussion forums or other public areas, entering a contest or sweepstakes, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself by filling out and submitting an online form. 

It is completely optional for you to engage in these activities. If you elect to engage in these activities, however, we may ask that you provide us personal information, such as your first and last name, mailing address (including zip code), email address, website, employer, job title and department, telephone and facsimile numbers, and other personal identifying information. 

These are the categories of Personally Identifiable Information we collect:

Account data

Our website and applications require you to register in order to use some or all of the functionality. If you choose to register for an account you will provide us with some personal data, including your name, email address, username, and password. We collect this data because it is necessary to provide you access to our services and maintain the security of our services. We may use your data to communicate with you regarding your account. We retain account data as long as your account is active. You can cancel your account at any time and, if you do, we remove or anonymize your account data.

Log-ins and attempted log-ins — When you create a user account, log in, log out, or attempt to log in with invalid credentials, we record the date, time, your user ID (if you are logged in), IP address, the website address (URL) you accessed, web browser type, and a description of the event, which would include the email address you registered your account with.

Participation data

When ordering products or services or registering for a membership, program, conference or exhibition on our website and affiliated NATPE web pages hosted elsewhere on the internet, you may be asked to provide a credit card number. Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity because we need that information to provide you the activities you required.

This data may include whether you attend a particular conference session or exhibition, how long you spend reading the questions and collecting the required documents, when and how often you access the application form, whether you completed the form, when and how much you contribute to document uploads and other application activities, and your responses to our questions. We collect this data for the purpose of providing us with oversight and understanding of how you ordered our products or services or registered for a membership, program, conference or exhibition.

Legal basis for collection of participation data: your consent and our legitimate interest in monitoring and improving our services.

Profile data

Some of our websites and applications allow you create a personal profile. If you chose to create a profile the data we collect may include your name, telephone number, picture, address, email address, job title or role, employer, preferred language, and time zone. We collect and use profile data to allow you to collaborate with other users of our services. When you provide profile data you consent to us providing that data to other users and should understand that we cannot control what those users do with your data. You can change or remove your profile data at any time. If you create a profile during a training event the data is automatically deleted at the end of the event.

Email open and click-through — We collect information about whether you have opened email messages from us and/or clicked on links in those emails. This helps us evaluate the relevance of the content in our communications.

Visits to shortcut website addresses—Some published website addresses are shortcuts that redirect you to a page with a longer address. When a redirect is initiated, we log the shortcut website address, date, time, and IP address.

Legal basis for collection of profile data: your consent.

Publication data

Some of our websites allow you to post chat and/or forum messages. If you do so, the publication data may include your name, alias, time of publication, your message, and a sentiment score. We use publication data only as necessary to enable the publication and allow the intended exchange of information between users of our services. When you provide data for publication you consent to us making that data visible to other users and should understand that we cannot control what those users do with your data. Publication data may be retained forever unless you request it be deleted.

Marketing data

We may use your personal data for marketing purposes. This marketing data may include your name, phone number, email address, employer, service or product interest information. We collect this data when you submit an inquiry from our websites or express interest in our products or services via email or phone. Additionally, we may collect your marketing data from 3rd parties with whom you have agreed to share your data. We use the marketing data for the purposes of offering, marketing and selling our products and services to you. We use a 3rd-party sales automation provider, LeadRocket, to manage your marketing data. You can request to have your marketing data removed at any time by contacting us by email at privacy@natpe.org or by clicking the Unsubscribe link in one of our emails. Legal basis for collection of marketing data: your consent.

Transaction data

If you purchase products or services from us, we collect your personal information related to this transaction. This may include your contact details, products or services purchased, price paid, time of purchase, and payment type. We use this data so can provide the purchased product or service and to keep proper records of those transactions. Financial transactions are processed using our PCI-compliant 3rd-party financial services provider PayPal. This provider stores financial data related to your transaction, including credit card details, billing address, etc. We do not collect or process your personal financial data. Legal basis for collection of transaction data: performance of a contract between you, or your employer, and us.

Job application data

If you apply for a job with us, we use the information you provide to evaluate your qualifications for employment. This information includes your name, email, phone, address, employment history, educational background, and any other information you include in your application or resume. We may share the information you provide with anyone who can assist us in evaluating your qualifications. This may include former employers, co-worker and references, educational institutions, etc. We use our own hiring management application to process your application data. We have configured our hiring management application to automatically delete your application data 4 months after you apply.

Legal basis for collection of job application data: your consent.

Support data

If you contact us for technical support, you have to provide some personal data which may include your name, your employer, email address, phone number, time zone, and reason for requiring support. We use the support data to help solve your problem and to better understand the types of problems our users have. We use our own help desk software to store and track your support request and associated data. We do not share your support data with anyone other than our help desk personnel and only to the extent necessary for handling your support request. We keep support data for 1 year, after which it is automatically deleted.

B. Nonpersonally Identifiable Information

This refers to information that does not by itself identify you specifically. We gather certain information about you based upon where you visit on our website and affiliated NATPE web pages hosted elsewhere on the internet, in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the Website's Uniform Resource Locator (“URL”) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP”) address. 

A URL is the global address of documents and other resources on the World Wide Web. An IP address is an identifier for a computer or device on a Transmission Control Protocol/Internet Protocol (“TCP/IP”) network, such as the World Wide Web. Networks like the Web use the TCP/IP protocol to route information based on the IP address of the destination. 

In other words, an IP address is a number that is automatically assigned to your computer whenever you are surfing the web, allowing web servers to locate and identify your computer. Computers require IP addresses in order for users to communicate on the Internet. 

The following are categories of Nonpersonally Identifiable Information we collect:

Log data

When you access our websites and applications our servers automatically log data such as your IP address, operating system type and version, browser type and version, etc. We use this data to help us ensure the security of our services and to provide technical support.

Legal basis for collection of log data: our legitimate interest in properly administering and securing our websites and services.

Aggregated usage data

We use Google Analytics to collect and aggregate data about your use of our website and services. This data may include your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, feature usage, as well as information about the timing, frequency and pattern of your service use. We use this data to analyze the use of our websites and to help us make good decision about changes we make.

For example, it may help us decide which languages to translate our website to in reviewing the aggregated usage data to determine what percentage of our users come from which countries. We have executed the data processing addendum (DPA) with Google and set the retention of your usage data to 24 months.

2.         Collection Methods

We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us. You provide certain Personally Identifiable Information to us when you: 

(a) register for our Services; 
(b) enter contests sponsored by us or one of our partners; 
(c) sign up for special offers from us or our Affiliates; 
(d) send email messages, submit forms or transmit other information through any means to us;
(e) use our website and affiliated NATPE web pages hosted elsewhere on the internet to send messages to other Users;
(f) submit your credit card or other payment information when ordering and purchasing our Services on our website and affiliated NATPE web pages hosted elsewhere on the internet. We may also collect information from you at other points on our website that state that such information is being collected. 

We have to hold the details of the people who have requested our service in order to provide it. However, we only use these details to provide the service the person has requested and for other closely related purposes. For example, we might use information about people who have registered to one of our events to carry out a survey to find out if they are happy with the level of service they received. When people do subscribe to our services, they can cancel their subscription at any time and are given an easy way of doing this. 

We use your Personally Identifiable Information to provide our Services to you, as required by our agreements with you, such as event registration, hotel accommodations, streaming sessions, attendee lists, etc. We also use your Personally Identifiable Information to compile lists, directories and databases of attendees, participants, speakers, members, providers, and exhibitors connected to our Services, to match Users, to improve our marketing and promotional efforts, to statistically analyze the use of our website, to improve our Service offerings, and to customize our website's content, layout, and Services.

When participants complete an entry in the format initiative PITCH & PLAY LIVE to showcase and distinguish original format ideas with international potential at one of our events they submit their materials and an application form. Any personal information that is provided is used only for the purpose of reviewing the PITCH & PLAY LIVE submissions.

When individuals complete a nomination for an award to be granted in one of our events they submit their information and that of the nominee in an application form. Any personal information that is provided is used only for the purpose of reviewing the nomination. The information about the winner will also be published on our own website.

3.         User Choices on Collection and Use of Information

We may, from time to time, send you information regarding our offerings and services (e.g., account verification, changes/updates to features of the Services, technical and security notice, newsletters). In addition, , we may occasionally send you direct mail or email about products and services from us and our partners that we feel may be of interest to you. 

Only NATPE (or agents working on behalf of NATPE and under confidentiality agreements) will send you these direct mailings and emails, and only if you indicated that you consent to these offers. Users are given the opportunity to "opt-in" of having their information collected and used for any of the above purposes. You can also “opt-out” from this consent at any time and from receiving specified types of communications from NATPE by clicking here. NATPE will typically only communicate with you according to your instructions. However, you may not opt out of particular Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Services, technical and security notices).

If you do not want to receive such mailings in the first place, simply tell us when you give us your personal information at registration either at the event or on our website consent form. Or, at any time, you can easily edit your account information to no longer receive such offers and mailings. You can update your personal information on your NATPE account by clicking here. Should you experience problems with updating your information please contact us at privacy@natpe.org, and we will try to resolve your issues.

You also have choices with respect to cookies, as described below. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our website may not work properly in your case.

4.         Information Sharing

We do provide some of our services through contractual arrangements with our Affiliates, services providers, and other third parties. We use your Personally Identifiable Information to operate our website as described above and our Affiliates are only allowed to use the information to deliver Services. For example, we must release your credit card information to a card-issuing bank to confirm payment for Services purchased on this website; we release your address information to the deliverer of any service or product that you ordered; and provide order information to third parties that help us provide customer service.

Occasionally we may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. We will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

5.         Security of Information

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

At our website your Personally Identifiable Information is secure, consistent with current industry standards. The importance of security for all Personally Identifiable Information associated with our user is of utmost concern to us. Your Personally Identifiable Information is protected in several ways. 

Access by you to your Personally Identifiable Information is available through a password and unique user ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your Personally Identifiable Information resides on a secure server that only selected NATPE personnel and Information Technology contractors have access to via password. We encrypt your Personally Identifiable Information and thereby prevent unauthorized parties from viewing such information when it is transmitted to us.

Personal information that you provide that is not Personally Identifiable Information also resides on a secure server and is only accessible via password. Since this information is not accessible from outside NATPE you will not be asked to select a password in order to view or modify such information.

In order to most efficiently serve you, credit card transactions and order fulfillment are handled by established third party banking, processing agents, distribution institutions. They receive the information needed to verify and authorize your credit card or other payment information and to process and ship your order. In order to best promote your businesses and projects, customer list rentals are handled by established third party fulfillment houses. They receive the information about you and your business/projects needed to best promote your business/projects to the individuals and companies on our customer lists.

6.         Cookies

To make this site work properly, we sometimes place small data files called cookies on your device. Most big websites do this too.

What are cookies?

A cookie is a small text file that a website saves on your computer or mobile device when you visit the site. It enables the website to remember your actions and preferences (such as login, language, font size and other display preferences) over a period of time, so you don't have to keep re-entering them whenever you come back to the site or browse from one page to another.

How do we use cookies?

Our cookies store randomly assigned user identification numbers, the country where you are located, and your first name to welcome you back to our website. A number of our pages use cookies to remember:

The cookie-related information is not used to identify you personally and the pattern data is fully under our control. These cookies are not used for any purpose other than those described here.

How to control cookies

You can control and/or delete cookies as you wish. You can delete all cookies that are already on your computer and you can set most browsers to prevent them from being placed. When we use an outside ad serving company to display banner advertisements on our website, they will place a separate cookie on your computer as part of their service. We will not provide any third-party ad server with any of your Personally Identifiable Information or information about your purchases. We and our third party ad server will collect and use your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server and whether you responded to a particular ad. Under the European Union (EU) General Data Protection Regulation (GDPR), you have rights as an individual which you can exercise in relation to the information we hold about you.

Right to file a complaint

You have a right to file a complaint with the appropriate regulatory authority responsible for data protection.

NATPE tries to meet the highest standards when collecting and using personal information. For this reason, we take any complaints we receive about this very seriously. We encourage people to bring it to our attention if they think that our collection or use of information is unfair, misleading or inappropriate. We would also welcome any suggestions for improving our procedures.

This privacy notice was drafted with brevity and clarity in mind. It does not provide exhaustive detail of all aspects of NATPE’s collection and use of personal information. However, we are happy to provide any additional information or explanation needed. Any requests for this should be sent to the address below.

If you want to make a complaint about the way we have processed your personal information, you can contact your national EU regulator or statutory body which oversees data protection law in your country.

Right to access

NATPE tries to be as open as it can be in terms of giving people access to their personal information. Individuals can find out if we hold any personal information by making a ‘subject access request’ under the GDPR. If we do hold information about you we will:

-           give you a description of it;
-           tell you why we are holding it;
-           tell you who it could be disclosed to; and
-           let you have a copy of the information in an intelligible form.

If you request a copy of your personal data and provide sufficient proof of identity, we will supply to you a copy of your personal data. The first copy will be provided free of charge, but additional copies may be subject to a reasonable fee.

Right to completeness and accuracy

You have the right to have any inaccurate personal data about you corrected and, in some cases, have any incomplete personal data about you completed. You can request us in writing to correct or complete your personal data at any time by email to privacy@natpe.org, or writing to the address provided below, with proper means of identification.

If you agree, we will try to deal with your request informally, for example by providing you with the specific information you need over the telephone, after you give us proper means of identification.

Right to be forgotten

In some circumstances you have the right to ask us to remove your personal data. You can request us to remove your personal data at any time by email to privacy@natpe.org, or writing to the address provided below, with proper means of identification.

Right to restrict use

In some circumstances you have the right to ask us to stop using your personal data but also ask us not to remove it. You can request us to restrict or stop use of your personal data at any time by email to privacy@natpe.org, or writing to the address provided below, with proper means of identification.

Right to object to marketing

You have the right to object to our use of your personal data for marketing purposes. You can object to our use of your personal data for marketing purpose at any time by email to privacy@natpe.org, or writing to the address provided below, with proper means of identification.

Right of portability

In some circumstances you have a right to request an electronic copy of the private data we have about you. You can request such electronic copy of your personal data at any time by email to privacy@natpe.org, or writing to the address provided below, with proper means of identification.

Right to withdraw consent

If you consented to allow us to collect private data from you, you have the right to withdraw that consent at any time by email to privacy@natpe.org, or writing to the address provided below, with proper means of identification.

You can exercise any of your rights in relation to your personal data via written notice to us at any time by email to privacy@natpe.org, or writing to the address provided below, with proper means of identification.

8.         Job applicants, current and former NATPE employees

NATPE is the data controller for the information you provide during the hiring process unless otherwise stated. If you have any queries about our hiring process or how we handle your information please contact us at privacy@natpe.org

What will we do with the information you provide to us?

All of the information you provide during the hiring process will only be used for the purpose of processing your application, or to fulfill legal or regulatory requirements if necessary.

We will not share any of the information you provide during the recruitment process with any third parties for marketing purposes or, in case of employment in the European Economic Area (EEA), transfer any of your information outside of the EEA. The information you provide will be held securely by us and/or our data processors whether the information is in electronic or physical format.

We will use the contact details you provide to us to contact you to progress your application. We will use the other information you provide to assess your suitability for the role you have applied for. 

What information do we ask for, and why?

We do not collect more information than we need to fulfill our stated purposes and will not retain it for longer than is necessary. The information we ask for is used to assess your suitability for employment. You don’t have to provide what we ask for but it might affect your application if you don’t. 

Application stage

We ask you for your personal details including name and contact details. We will also ask you about your previous experience, education, referrals and for answers to questions relevant to the role you have applied for. Our recruitment team will have access to all of this information.

You will also be asked to provide equal opportunities information. This is not mandatory information – if you don’t provide it, it will not affect your application. This information will not be made available to any staff outside of our recruitment team, including hiring managers, in a way which can identify you. Any information you provide, will be used only to produce and monitor equal opportunities statistics.

Short-listing

Our hiring managers shortlist applications for interview. They will not be provided with your name or contact details or with your equal opportunities information if you have provided it.

Assessments

We might ask you to participate in assessment days; complete tests or occupational personality profile questionnaires; and/or to attend an interview – or a combination of these. Information will be generated by you and by us. For example, you might complete a written test or we might take interview notes. This information is held by NATPE.

If you are unsuccessful at any stage of the process, the information you have provided until that point will be retained for 6 months from the closure of the campaign. We may ask if you would like your details to be retained in our talent pool for a period of six months. If you say yes, we would proactively contact you should any further suitable vacancies arise. 

Information generated throughout the assessment process, for example interview notes, is retained by us for 6 months following the closure of the campaign.

Equal opportunities information is retained for 6 months following the closure of the campaign whether you are successful or not.

If you are successful, the information you provide during the application process will be retained by us as part of your employee file for the duration of your employment plus 6 years following the end of your employment. This includes your criminal records declaration, fitness to work, records of any security checks and references.

How we make decisions about recruitment?

Final recruitment decisions are made by hiring managers and members of our recruitment team. All of the information gathered during the application process is taken into account. You are able to ask about decisions made about your application by speaking to your contact within our recruitment team or by emailing hr@natpe.org.

Conditional offer

If we make a conditional offer of employment we will ask you for information so that we can carry out pre-employment checks. You must successfully complete pre-employment checks to progress to a final offer. We are required to confirm the identity of our staff, their right to work in the United States and seek assurance as to their trustworthiness, integrity and reliability. 

You will therefore be required to provide: 

·         Proof of your identity – you will be asked to attend our office with original documents, we will take copies.
·         Proof of your qualifications – you will be asked to attend our office with original documents, we will take copies.
·         You will be asked to complete a criminal records declaration to declare any convictions.
·         We will contact your referrals, using the details you provide in your application, directly to obtain references
·         We will also ask you to complete a questionnaire about your health. This is to establish your fitness to work. 

If we make a final offer, we will also ask you for the following:

·         Bank details – to process salary payments;
·         Emergency contact details – so we know who to contact in case you have an emergency at work;
·         Membership of a pension scheme – so we can send you a questionnaire to determine whether you are eligible to re-join your previous scheme. 

Our Code of Conduct requires all staff to declare if they have any potential conflicts of interest, or if they are active within a political party. If you complete a declaration, the information will be held on your personnel file.

Use of data processors 

Data processors are third parties who provide elements of our recruitment service for us. We have contracts in place with our data processors.
